It is somewhat ironic, actually make that criminal, that two days after new SEC head Mary Jo White (whose conflict of interest list is so vast courtesy of her prior position as defending every Wall Street from their criminal acts she now has to recuse herself from virtually every enforcement action) solemnly promised Congress under oath that the "markets are not rigged", the SEC comes out swinging and slaps the wrist of the NYSE with an intolerable $4.5 million fine for allowing market rigging "for a period of time from 2008 to 2012."

From the SEC complaint:

The Securities and Exchange Commission today announced an enforcement action against the New York Stock Exchange and two affiliated exchanges for their failure to comply with the responsibilities of self-regulatory organizations (SROs) to conduct their business operations in accordance with Commission-approved exchange rules and the federal securities laws.  Also charged was the NYSE exchanges’ affiliated routing broker Archipelago Securities.

The details:

“The order highlights instances where the exchanges conducted business without a rule in place due to weak or inadequate policies and procedures,” said Antonia Chion, an associate director in the SEC’s Division of Enforcement.  “In other instances, the exchanges did not operate in compliance with their effective rules.  Both failures reflect a troubling lack of compliance with the requirements and obligations imposed on securities exchanges.”

The violations detailed in the SEC’s order occurred during periods of time from 2008 to 2012.  The SEC’s order finds that the NYSE exchanges violated Section 19(b) and 19(g) of the Securities Exchange Act of 1934 through misconduct that included the following:

• NYSE, NYSE Arca, and NYSE MKT (formerly NYSE Amex) used an error account maintained at Archipelago Securities to assume and trade out of securities positions without a rule in effect that permitted such trading and in a manner inconsistent with their rules for the routing broker, which limited Archipelago Securities’ activity primarily to outbound and inbound routing of orders on behalf of those exchanges.
• NYSE provided co-location services to customers on disparate contractual terms without an exchange rule in effect that permitted and governed the provision of such services on a fair and equitable basis.
• NYSE operated a block trading facility (New York Block Exchange) that for a period of time did not function in accordance with the rules submitted by NYSE and approved by the SEC.
• NYSE distributed an automated feed of closing order imbalance information to its floor brokers at an earlier time than was specified in NYSE’s rules.
• NYSE Arca failed to execute Mid-Point Passive Liquidity Orders (MPLOs) in locked markets (where the bid and ask prices are the same) contrary to its exchange rule in effect at the time.

In addition, the SEC’s order finds that NYSE Arca accepted MPLOs in sub-penny amounts for National Market System stocks trading at over $1.00 per share, in violation of Rule 612(a) of Regulation NMS.

The SEC’s order further finds that Archipelago Securities failed to establish and maintain policies reasonably designed to prevent the misuse of material, nonpublic information in connection with error account trading.  Archipelago Securities also violated and failed to give the SEC timely notice of its violation of the net capital rule – a critical federal securities law provision intended to ensure that brokers and dealers remain solvent and can meet their financial obligations.  

Or in other words, the SEC is claiming that for 5 years the NYSE was aiding and abetting the very same rigged market that the SEC swears does not exist.

It. Just. Does. Not. Compute.

But ministers at the time rejected the claim and used the attack to whip up public anger against the Germans.

'Take up the sword of justice – avenge the Lusitania' read one famous poster. The campaign was used effectively in Ireland, where conscription was not compulsory.

However, secret government documents released under the 30-year-rule this week reveal that the German claims may have been right all along.

After salvage companies applied to raise the 790ft Cunard liner in 1982, the Government fired off warnings about danger to life, according to the National Archives documents.

HOW THE SINKING WAS USED WIN OVER THE US AND THE IRISH 

The sinking was a tragedy for more than a 1,000 men, women and children who died - but it was used relentlessly by the British Government to convince Irish and American sceptics to help defeat 'the hun'. 

Irish men were urged to 'take up the sword of justice - avenge the Lusitania' amid widespread public disgust over the torpedo attack.

A series of posters were produced featuring pictures of the dramatic scene.

American fury over the attack swung public opinion firmly onto the side of the allies - and against the Germans. 

This helped President Woodrow Wilson take the US into the war in 1917.

Officials feared attempts to survey the wreck would reveal an illegal stash of ammunition - discrediting one of the key reasons why the the Americans were dragged into the war.

Files show that the Ministry of Defence even went as far as warning divers that the wreck could contain explosives.

Foreign and Commonwealth Office files show that officials feared the controversy would 'literally blow up on us' denting Britain's special relationship with the US.

There were also concerns that American survivors and relatives of those who died could sue the Government.

In a secret memo, Noel Marshall, from the Foreign Office's North American department, said: 'Successive British governments have always maintained that there was no munitions on board the Lusitania (and that the Germans were therefore in the wrong to claim to the contrary as an excuse for sinking the ship).

'The facts are that there is a large amount of ammunition in the wreck, some of which is highly dangerous.'

He added: 'I am left with the uneasy feeling that this subject may yet - literally - blow up on us.'

The Lusitania was steaming from New York to Liverpool when she was hit by the German submarine U-20 on May 7, 1915.

The explosives, after being hit by the German torpedo, sparked a larger blast causing the giant liner -  a sister ship of the Titanic - to sink in just 18 minutes.

The Government has admitted that there were 4,200 'small arms' cartridges and ammunition cases on the ship - and these were declared at the time. But they were not classified as 'ammunition'.

Experts claim these could not have been responsible for the second giant explosion which sunk the liner.

A senior government lawyer, Jim Coombes, warned there could still be a political scandal if it was found that there had actually been explosives on board.

'It cannot be denied that the sinking of the Lusitania did much to sway American opinion in favour of entering the war,' he wrote.

'If it were now to come to light that there was after all some justification, however slight, for the torpedoing, HMG's relations with America could well suffer.'

The UK's relationship with America was crucial in 1982 - at the height of the Cold War. 

It was also the year in which British troops marched into Port Stanley in the Falklands War.

Among those who died in the tragedy included politicians, artists, academics and businessmen, as well as the art collector, Sir Hugh Lane, who is said to have been carrying paintings by Titian, Monet and Rubens in sealed containers.

Since 1982, there have been a number of dives and surveys of the wreck, including one in 2012 which found no evidence of any high explosives and concluded the second blast reported by some of the 761 survivors was one of the ships boilers exploding.

However the wreck’s owner, Gregg Bemis, an entrepreneur, from New Mexico, who has been trying for 40 years to find out if the ship had a secret military cargo, has asked the Irish Government to sanction further dives to prove his theory.

In 1918 a New York judge had ruled that there were 4,200 cases of safety cartridges, 18 fuse cases and 125 shrapnel cases without any powder charge on board the liner when it went down.

But he ruled that these did not constitute 'war munitions'. He added that the Lusitania had not been armed or carried any high explosives.

The 1915 British inquiry into the sinking of the Lusitania, chaired by Lord Mersey, barely touched on the issue.

But when a French survivor, Joseph Marichal, a former army officer, claimed that the ship had sunk so quickly because of a second explosion, his testimony was quickly dismissed.

Mr Marichal, who had been in the second-class dining room, said the explosion was 'similar to the rattling of a maxim gun for a short period' and came from underneath the whole floor.

But Lord Mersey said: 'I do not believe him. His demeanour was very unsatisfactory. There was no confirmation of his story.'

You and I both operate in the arena of words and ideas… freedom of expression and thought… that is the coin of our realm. 

I really think it is the duty of journalists and people in the media to look at any potential instance of the government coming in and trying to monitor or potentially criminalize thoughts and words.

Senator Markey wants this obscure Federal Agency to scour these online sources… TV, radio and so on… for any speech they find threatening. He wants them to do it in connection with the Department of Justice, the U.S. Commission on Civil Rights, and then file a report with Congress on what out there is potentially hateful and could lead to hate crimes.

This is clearly Big Government sticking its nose into people’s speech and their thoughts.

There’s no criteria in the bill… what’s the template? When you go through and check the boxes what counts as hate speech and who makes the determinations? It’s this abstruse group that no one’s ever heard of buried within the bureaucracy of the federal government.

The definitions for what constitutes hate speech are broad or non-existent, making such a bill that much more dangerous. According to the Examiner, “The bill does not specify what, exactly, constitutes “hate,” but given the source of the proposal, it’s not too difficult to figure out.”

The proposed bill has prompted concerns that individuals or groups who speak out against the government or disagree with certain politicians will be identified as inciting hate.

Many questions about how the process of finding hateful people in the United States via the internet would work have been left unanswered.

A few weeks ago Senator Harry Reid of Nevada referred to protesters at Bundy Ranch as “domestic terrorists.” Since these people defied official directives and hate the idea of government overreach, would they now also fall under new hate speech guidelines being proposed by Senator Markey? Will they be added to yet another red list and flagged as persons of interest for simply posting their thoughts in a forum on the internet?

Psychiatrists are now identifying those who express their frustrations with the government as a mental illness called Oppositional Defiance Disorder (ODD) as per the official Diagnostic and Statistical Manual (DSM-V). Under the new proposal from Senator Markey defiant thoughts or ideas could potentially not only leave you diagnosed as mentally ill, but also a “hater.”

Will “hate” now be deemed a terrorist activity such as making a gun gesture with your hand, purchasing ammunition, or paying cash for items at the grocery store?

As we noted previously, there are already pre-crime systems actively monitoring the internet looking for discussions and behaviors that can be used to identify potential criminals before any crime occurs. Combined with new Web Bot hate speech tools, could the government then preempt detentions and arrests under the Patriot Act or National Defense Authorization Act, both of which allow for action to be taken against those who threaten national security, yet another broadly define term?

The bill is full of loop holes and broad assumptions, as is generally the case with government mandates. And, with the Department of Justice included within the new ‘hate speech’ mandates it should be clear that the end goal is criminalization of thoughts and expressions that go against the prevailing agenda.

All that aside, perhaps we should just pass the bill first before we find out what’s in it.
